Terms of Service

1. Acceptance of these Terms

By visiting the marketing site, joining the waitlist, or using the SYMPHONIC service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

2. The Services

SYMPHONIC is an integrated back-office software platform for small businesses. As of the date of these Terms, the SYMPHONIC service is in pre-launch and the Services consist primarily of the marketing site and the waitlist signup. We will provide additional terms or notices that apply to the SYMPHONIC application when it becomes generally available.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is older) to use the Services. If you use the Services on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms, and “you” refers to that entity.

4. Your account and information

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You agree to provide accurate, complete information and to keep it up to date. Notify us promptly at info@digilabscore.com if you suspect any unauthorized access.

5. Acceptable use

You agree not to:

• Use the Services for any unlawful purpose or in any way that infringes the rights of others;
• Attempt to interfere with, disrupt, or compromise the security or integrity of the Services or any servers, networks, or accounts associated with them;
• Reverse engineer, decompile, or disassemble any part of the Services except to the extent permitted by applicable law;
• Scrape, harvest, or otherwise collect information from the Services in bulk or via automated means without our express written consent;
• Use the Services to send spam, malware, or other harmful content, or to harass, threaten, or harm anyone;
• Misrepresent your identity or affiliation with any person or organization.

6. Your content; your data is yours

You retain all rights in any data, records, or content you provide through the Services (“Your Content”). You grant us a limited license to host, store, transmit, and process Your Content solely as needed to provide and improve the Services for you. We do not sell Your Content, share it with third parties for advertising, or use it to train AI models that benefit other customers.

7. Our intellectual property

The Services, including the SYMPHONIC software, the marketing site, the SYMPHONIC name and logo, and all related materials, are owned by Digi Labs Core or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms. No other rights are granted by implication or otherwise.

8. Pricing and payment

Joining the waitlist is free and creates no payment obligation. Pricing for the SYMPHONIC service will be made available at or before launch and will be governed by additional terms you accept at sign-up.

9. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of dealing.

We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected. You use the Services at your own risk.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Digi Labs Core, LLC or its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or relating to your use of the Services.

Our aggregate liability for any claim arising out of or relating to these Terms or the Services will not exceed the greater of (a) the amounts you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations on liability, so the limitations above may not apply to you in full.

11. Indemnification

You agree to indemnify and hold harmless Digi Labs Core, LLC and its officers, employees, and affiliates from any claim, demand, loss, or damages, including reasonable attorneys’ fees, arising out of or related to your breach of these Terms, your use of the Services, or your violation of any law or the rights of any third party.

12. Termination

You may stop using the Services and request deletion of your information at any time by emailing info@digilabscore.com. We may suspend or terminate your access to the Services if you violate these Terms or if we reasonably believe you have used the Services in a way that creates risk or legal exposure for us or for others. Sections that by their nature should survive termination will survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services that is not resolved informally will be brought exclusively in the state or federal courts located in Tulsa County, Oklahoma, and you and Digi Labs Core consent to personal jurisdiction in those courts.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, if the changes are material, take reasonable steps to notify you. Your continued use of the Services after the changes take effect constitutes your acceptance of the revised Terms.

15. Miscellaneous

These Terms, together with the Privacy Policy and any additional terms we present to you for specific Services, make up the entire agreement between you and Digi Labs Core regarding the Services. If any provision is found to be unenforceable, the remainder will continue in full force. Our failure to enforce any provision is not a waiver of our right to do so later.
